Terms of Service
These terms are written in plain English. By creating a WAOps account and using our platform, you agree to these terms. Please read them — they're not very long.
1. About WAOps
WAOps is a WhatsApp automation platform operated by Dunn C Automations, based in Kenya. We provide software that allows businesses to automate customer conversations on WhatsApp using the official WhatsApp Cloud API.
By using WAOps, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.
2. Eligibility
To use WAOps you must:
- Be at least 18 years old
- Be operating a legitimate business in Kenya or another jurisdiction
- Have a valid WhatsApp Business account and Meta developer credentials
- Agree to WhatsApp's Business Policy and Meta's Platform Terms
3. Your account
You are responsible for keeping your login credentials secure. Do not share your password with anyone. You are responsible for all activity that occurs under your account.
If you believe your account has been compromised, contact us immediately at dunnchumo@gmail.com.
We reserve the right to suspend or terminate accounts that violate these terms, without prior notice in cases of serious violations.
4. Acceptable use
You may use WAOps only for lawful business communication. You agree not to use the platform to:
- Send spam, unsolicited bulk messages, or messages to people who have not consented to hear from your business
- Harass, threaten, or deceive your customers
- Impersonate another business or individual
- Send content that is illegal, harmful, fraudulent, or violates WhatsApp's policies
- Scrape, reverse-engineer, or attempt to access our platform in unauthorised ways
- Resell or sublicense access to WAOps without our written permission
Violating WhatsApp's messaging policies may result in your WhatsApp Business account being banned by Meta. WAOps is not responsible for account bans resulting from your misuse of the platform.
5. Your customers' data
When your customers message your WhatsApp number, their conversation data is processed through WAOps. You are responsible for:
- Informing your customers that their messages are handled by an automated system
- Complying with Kenya's Data Protection Act 2019 in your use of customer data
- Not using WAOps to collect sensitive personal data (health, financial, identity documents) without appropriate safeguards
WAOps processes this data on your behalf as a data processor. You remain the data controller for your customers' information.
6. Subscriptions and billing
WAOps offers a free 14-day trial followed by paid monthly subscription plans. Pricing is listed at waops.xyz/#pricing.
- Subscriptions renew automatically each month unless cancelled
- You may cancel at any time — cancellation takes effect at the end of the current billing period
- We do not offer refunds for partial months unless required by Kenyan consumer law
- We reserve the right to change pricing with 30 days' notice to active subscribers
Payments are processed via M-Pesa or Stripe. We do not store your payment credentials.
7. Service availability
We aim to keep WAOps available at all times but we do not guarantee uninterrupted service. Downtime may occur due to maintenance, infrastructure issues, or factors outside our control including Meta/WhatsApp API outages.
We will communicate planned maintenance in advance where possible. We are not liable for losses caused by service interruptions.
8. WhatsApp API dependency
WAOps is built on Meta's WhatsApp Cloud API. We have no control over Meta's platform decisions, including changes to API terms, pricing, or availability. If Meta discontinues or significantly changes the WhatsApp Cloud API, we will notify you and work to find alternatives, but we cannot guarantee continuity of service in such circumstances.
9. Intellectual property
The WAOps platform, including its code, design, and branding, is owned by Dunn C Automations. You may not copy, reproduce, or create derivative works from our platform without written permission.
Content you create within WAOps — your automation rules, welcome messages, and business settings — remains yours. We claim no ownership over your business content.
10. Limitation of liability
To the maximum extent permitted by Kenyan law, WAOps and Dunn C Automations are not liable for:
- Loss of revenue or business opportunities arising from platform downtime
- WhatsApp account bans resulting from policy violations on your part
- Data loss due to circumstances outside our reasonable control
- Indirect, incidental, or consequential damages of any kind
Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.
11. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation.
On termination, your data will be retained for 30 days in case of disputes, then deleted upon request.
12. Governing law
These terms are governed by the laws of Kenya. Any disputes shall be resolved under Kenyan jurisdiction.
13. Changes to these terms
We may update these terms as the platform grows. We will notify active subscribers by email at least 14 days before significant changes take effect. Continued use of WAOps after that date constitutes acceptance of the updated terms.
